What is Collaborative Law / Collaborative Divorce?

Collaborative Divorce is an alternative to traditional litigation regarding settling issues such as the distribution of marital assets, child custody, and support.

Spouses and their respective divorce lawyers agree, in writing, to exercise good faith and best efforts to resolve disputes without judicial intervention.

Unlike traditional litigation, a collaborative divorce requires a commitment to share all information openly, treat each other with respect, and to abstain from being combative.

How Does a Collaborative Divorce Work? 

At the outset of the case, the parties agree, along with their respective attorneys, to hold a series of structured meetings in an effort to work toward a final settlement.

Separation, divorce, support, and custody issues often involve a wide range of emotions, including disappointment, anxiety, hurt feelings, depression, and anger.

That’s entirely normal.

Simply saying “I want a divorce,” doesn’t suddenly make everything all right or change areas of conflict.

The question is, “How do we resolve disputes and move on with our lives, without subjecting ourselves (and our children) to the trauma of traditional litigation?”

We think private matters are best kept private.  That’s one reason we are proponents of Collaborative Family Law.
